These Terms & Conditions ("Terms") govern the use of the AI-powered food photo enhancement and related services (the "Service") provided by the Service Provider via proplate.me. By finalizing an order (clicking the "Pay" button), the Customer accepts these Terms. The current version of the Terms is always available at proplate.me/terms.

Customer: The natural or legal person ordering the Service. The Service is primarily designed for hospitality businesses (B2B). Consumer: A natural person acting outside the scope of their trade, profession, or business, as defined in Section 8:1(1)(3) of the Hungarian Civil Code (Act V of 2013). Package: A fixed-price service bundle defined on proplate.me (e.g. Starter, Pro, Premium) including a specified number of AI-enhanced photos and/or videos.

The Service Provider performs AI-based enhancement of food photos provided by the Customer or sourced from publicly available channels (e.g. Google Maps), and optionally generates short videos, in line with the purchased Package. The Service does not replace traditional food photography. The result depends on the quality of the source material. The Service Provider does not guarantee any specific visual outcome or business result (e.g. revenue uplift).

The Customer selects a Package on proplate.me, provides billing and contact details, and uploads or shares the source photos. The contract is concluded upon successful payment, confirmed by the Service Provider via email. The contract language is Hungarian or English (matching the interface language chosen by the Customer). The contract is not considered a written contract; it is filed electronically by the Service Provider.

Current prices are published on proplate.me. Prices are shown in Hungarian Forint (HUF) or Euro (EUR), depending on the chosen interface language. Prices include VAT, except where the Service Provider is VAT-exempt under Hungarian law — this is indicated on the invoice. Payment is processed via Stripe Payments Europe Ltd. (1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland). The Service Provider does not access or store the Customer's payment card data.

Delivery occurs within 5–7 business days from receipt of payment and the source photos, via email or a cloud download link. If the Customer fails to provide adequate source material within 30 days of payment, the Service Provider is entitled to consider the order fulfilled.

Customers qualifying as Consumers are generally entitled to a 14-day right of withdrawal under Hungarian Government Decree 45/2014 (II. 26.). However, since the Service constitutes the supply of digital content for which performance begins immediately upon order, the Consumer expressly consents at order finalization to the immediate commencement of performance and acknowledges that this consent results in the loss of the right of withdrawal under Sections 29(1)(a) and (m) of the said Decree. Customers ordering the Service in the course of their business (i.e. not as Consumers) are not entitled to the right of withdrawal.

Copyright in the original photos provided by the Customer remains with the Customer (or the original rights holder). The Customer warrants that they hold all necessary rights to use the uploaded photos. Upon full payment of the Service fee, the Customer obtains a non-exclusive, perpetual, worldwide license to the AI-enhanced images and generated videos, including for commercial use (social media, website, menu, advertising, Google Maps). The Service Provider may use the enhanced material for its own marketing purposes (portfolio, case study) — anonymized at the Customer's request.

The Service Provider's liability is limited to the actual amount of the service fee paid by the Customer. The Service Provider is not liable for indirect damages, loss of profit, or damages arising from third-party AI service providers (e.g. kie.ai, Google Gemini). The Service Provider does not warrant that the Service will be uninterrupted or error-free, or that AI-generated content will be of perfect quality in every case.

Complaints may be submitted to [CONTACT@PROPLATE.ME]. The Service Provider will substantively respond within 30 days of receipt. The Service Provider processes personal data as described in the Privacy Policy, in compliance with EU Regulation 2016/679 (GDPR) and Hungarian Act CXII of 2011 on Informational Self-Determination (Infotv.).

These Terms are governed by Hungarian law. The parties shall attempt to resolve any disputes amicably; failing this, they submit to the exclusive jurisdiction of the Hungarian court competent at the registered seat of the Service Provider, at the appropriate level. The Service Provider reserves the right to unilaterally amend these Terms. Amendments take effect upon publication on proplate.me. Contracts already concluded remain governed by the Terms in force at the time of order.
